COURT RULINGS REINFORCE JUDICIAL INDEPENDENCE AHEAD OF ELECTIONS

Recent court rulings on election-related petitions have been hailed by stakeholders as evidence that Zambia’s Judiciary is independently applying the law ahead of the August 13 general election.

Last week, the Constitutional Court dismissed a petition challenging the eligibility of Socialist Party president Fred M’membe and his running mate Dolika Banda. The court found that petitioners failed to provide sufficient evidence to prove claims that Banda did not possess a Grade 12 certificate or its equivalent, as required by the Constitution.

In a separate matter, the Lusaka High Court dismissed a petition challenging the nominations of 101 aspiring independent parliamentary candidates, filed by the Consortium of Civil Society Organisations for Good Governance and Constitutionalism and activist Isaac Mwanza.

Centre for Governance Executive Director, Patrick Mnthanga, said the judgments are important in enhancing public confidence in institutions responsible for safeguarding democracy.

“When citizens see the courts deciding cases independently and transparently, confidence in democratic institutions grows and political tensions are significantly reduced,” Mnthanga stated.

Political analyst Kelly Mumba added that the rulings should encourage political players to respect legal processes instead of attempting to influence public opinion outside the courts. He stressed that adherence to judicial decisions is critical in preserving constitutional order.

Chapter One Foundation Executive Director Josiah Kalala said the judgments show that the courts are capable of determining politically sensitive matters impartially, reinforcing public trust in the Judiciary as a cornerstone of Zambia’s democratic governance.
